Animation License Agreement (EULA)

Last updated: October 11, 2026 · Document version: v2.0

One-time Standard, Marketing and expressly identified group/subcategory animation licenses.

1. Scope, operator and independent purchase

Operator: TouchApp Inc., Delaware, United States.
Address: 16192 Coastal Highway, Lewes, DE 19958, United States.
Legal, privacy and support contact: support@plastictou.ch.

This agreement covers licensed animation downloads from PlasticTouch 3D. A one-time purchase grants the specified file-use rights, not copyright ownership, a subscription or a Bridge upgrade. No Bridge, Website, TV or AI subscription is required. The license applies to the animation(s), purchasing legal entity, tier and scope shown in the order.

Current catalog offers are Standard and Marketing licenses and supported group/subcategory orders. Branded production packages, source assets, commissioned work and copyright assignments are not included or offered automatically by a catalog purchase. Separately signed existing project agreements remain effective.

2. Standard license — one clinic / one location

A new Standard license is perpetual, non-exclusive and non-transferable, for one legal entity at one practice location. It permits downloading the covered files and using them on that practice’s website and waiting-room TV, including appropriate practice-owned presentations.

Social media, YouTube publication, paid advertising and other promotional distribution are not included in a new Standard license. Choose the Marketing license if you need those rights. It does not cover separate clinics, entities or additional locations, or grant resale, redistribution or sublicensing rights.

3. Marketing license

A new Marketing license includes Standard file-use rights plus use on the licensed entity’s social-media channels, YouTube and advertising, and unlimited practice locations under the same legal entity. The license is perpetual, non-exclusive and non-transferable.

Separate legal entities, franchisees and other agency clients are not covered merely because they share a brand or account. Marketing access does not authorize resale, redistribution, sublicensing, or sharing source files as a stock library. A separately specified order restriction remains applicable.

4. Group / subcategory scope

A supported group purchase covers the animations and usage rights expressly identified in that purchase. It does not grant the entire catalog, every future animation or an automatically changing bundle unless the order explicitly grants that scope. An existing group entitlement may include an individual animation; buying the same individual license is not necessary where the entitlement already covers it. Different subcategories and additional scopes require their own rights.

5. Downloads, online playback and formats

The license unlocks the downloadable versions supplied for the covered assets. File formats, resolution, language versions and availability are those identified for the purchase; a 4K file, production/source file or custom edit is not promised merely by the word “license.” Keep a backup of legitimately downloaded files. Temporary signed download URLs may expire without cancelling your license.

All platform-hosted online animation playback remains watermarked, including previews, playback by license holders and any supported hosted share or embed links. A license is not a purchase of watermark-free streaming. Provider-branded online copies and browser playback controls are separate from the licensed download assets.

Where your purchased download includes a clean file, you may use that supplied file under its license. This does not permit extracting clean media from a preview, bypassing a watermark, or using platform playback tokens as download licenses.

6. Permitted edits and practice responsibilities

You may make limited edits to a legitimately licensed download, such as cropping, formatting, captions, translations, your practice’s branding and concatenation, within the permitted use of your tier and without misrepresenting the educational content. No custom production service is included unless separately agreed.

The practice is responsible for the accuracy of its edits, medical statements, translations, advertising claims and legally required patient permissions. Do not fabricate outcomes, imply regulatory or surgeon endorsement of your practice, or present the animation as an individual treatment recommendation.

7. Restricted use, delegation and intellectual property

Do not sell, sublicense or redistribute raw assets, provide a download library to third parties, use the same license for unrelated legal entities, or use assets to train AI/ML models without express written permission. Do not scrape the catalog, screen-record previews to evade licensing or bypass access protections.

Delegated account access does not transfer a license. Agency or contractor access does not grant rights for other clients; any supply of files to a third party must be expressly permitted by your applicable license or agreement. Existing agreements granting production or agency rights retain that expressly purchased scope.

TouchApp Inc. and the applicable rights holders retain animation copyrights, brand rights and production/source assets. A clean downloaded file is licensed, not sold as intellectual-property ownership.

8. Earlier licenses, legacy access and cancellation

These descriptions govern new purchases made under this version. Rights already acquired under an earlier order, accepted license or separately signed agreement are not retroactively reduced by this update, account navigation changes, or acceptance of updated general terms. Existing paid subscriptions are not automatically cancelled, repriced or converted into another product. The new 3D offering does not promise watermark-free online playback; this operational playback rule does not cancel purchased animation download and file-use rights.

In particular, the new Standard restrictions above do not remove broader social-media or advertising rights that an earlier license expressly granted. A new license does not include complimentary Premium, Watch or platform streaming access. Existing legacy entitlements are assessed under their agreed scope, not used to sell a new bundled subscription.

Cancellation or expiry of an unrelated practice subscription does not terminate a perpetual file-use license. An expressly time-limited or revoked/refunded license remains subject to its own conditions.

9. Educational content and compliance

Animation content is educational only, not medical advice, a training credential or a guarantee of results. The licensed entity must comply with its medical-advertising, privacy, patient-consent and professional rules. Licensed files should not contain patient-identifiable data you lack authority to disclose.

10. Payment and digital-content refunds

The price, currency, taxes, tier and covered assets are displayed before purchase. Download access follows confirmed payment and the applicable entitlement. See the Refund & Cancellation Policy, including mandatory consumer withdrawal and faulty-content rights. Merely purchasing a license or accepting general terms does not by itself establish every legally required waiver.

11. Breach and remedies

We may restrict affected downloads or terminate rights for a material license breach, fraud or reversal of that purchase, subject to applicable law and any required process. Remedies may include damages or injunctive relief available under the applicable law or an enforceable, expressly agreed contract. We do not automatically charge a fixed penalty through your payment method. Unrelated valid purchased rights are not automatically forfeited.

12. Liability

To the maximum extent permitted by law, the Service and content are provided as available, without a guarantee of uninterrupted operation or suitability for a particular clinical outcome. We are not liable for indirect, incidental, special, consequential or punitive damages. Our total liability for claims relating to the Service shall not exceed the fees you paid to us in the 12 months preceding the claim; for a claim relating solely to an animation license, the limit is the amount paid for that license. These limits do not exclude liability that cannot lawfully be excluded or limit mandatory remedies.

13. Governing law and related policies

These terms are governed by the laws of Delaware, United States, without regard to conflict-of-law principles. Subject to mandatory applicable law, disputes shall be brought in the state or federal courts located in Delaware. Nothing in these documents excludes mandatory consumer, privacy, withdrawal or other rights, or mandatory jurisdiction rules, that cannot lawfully be waived.
