Terms of Service
Last updated: October 11, 2026 · Document version: v2.0
Bridge, Website, TV, AI receptionist and the separate PlasticTouch 3D licensing product.
1. Operator, acceptance and accounts
Operator: TouchApp Inc., Delaware, United States.
Address: 16192 Coastal Highway, Lewes, DE 19958, United States.
Legal, privacy and support contact: support@plastictou.ch.
PlasticTouch is a brand operated by TouchApp Inc. These Terms apply to use of our platform, together with the Privacy Policy, Refund Policy and, for animation purchases, the Animation License Agreement. You must be at least 18 to hold a purchasing or practice-management account, supply accurate information and keep your credentials secure. You are responsible for authorized account activity. Agencies may access only client workspaces they are authorized to manage.
2. Separate products and access
Bridge provides a practice profile and patient-facing page. Website and waiting-room TV are practice-product capabilities available under the selected subscription or separately displayed upgrade. The AI receptionist provides configured chat and, where enabled and purchased, voice capabilities. Access, quotas and optional features depend on the offer confirmed in your account.
PlasticTouch 3D is a separate animation licensing product at /3d, with its own catalog, purchase and download workspace. You may buy a 3D license without a Bridge, Website, TV or AI subscription. A shared sign-in does not combine contracts or grant access to a different product.
Bridge or Website access does not grant animation downloads, social-media or advertising rights. A 3D license does not activate Bridge, publish a practice page, start a platform trial or automatically create a recurring subscription.
3. Subscriptions, billing and complimentary access
New practice-product customers start with the Bridge offer displayed at signup. Current base offers are USD 49 monthly or USD 490 annually; available TV and Website upgrades, taxes, currency, quotas and the actual payable amount are shown in the applicable offer and checkout. Do not treat historical bundles or a former Bridge + 3D offer as a promise of the current product structure.
Paid subscriptions activate after payment confirmation, are charged upfront for the selected monthly or annual period and renew at that interval until cancelled. Stripe processes payments; we do not store full card numbers. Voice usage and AI allowances are not unlimited unless your specific order expressly says so.
Authorized complimentary access codes may grant the specified features for a stated period without a card. They do not cancel an existing paid subscription, authorize billing when free access expires, or automatically publish a draft. A legacy trial ends according to its originally agreed terms; new license purchases do not implicitly grant trials.
4. Changes, cancellation and refunds
Manage practice subscriptions through the billing controls in your practice account. Manage any retained legacy animation subscription through the billing controls associated with that 3D account. Each product must be managed separately; cancelling one does not cancel unrelated subscriptions or one-time animation licenses.
Cancellation stops future renewal and preserves already-paid access through the current paid period, unless a different lawful termination reason applies. It does not itself delete your account or content. Upgrades and downgrades are subject to the explicit price, proration and effective date confirmed in the billing flow; no universal immediate-upgrade or next-period-downgrade rule overrides that confirmation.
See the Refund & Cancellation Policy. Changes to existing subscription pricing or material terms will be communicated at least 30 days in advance where applicable, and apply prospectively. They do not automatically reprice grandfathered contracts.
5. Animation previews and download licenses
Online animation playback carries the PlasticTouch watermark, including playback by license holders and any supported hosted share or embed playback. A one-time license unlocks downloads of the covered animation files, not watermark-free platform streaming.
Standard and Marketing licenses have different permitted uses. Group/subcategory orders cover the scope expressly identified in the order; they are not subscriptions or ownership of the entire catalog. Available formats and included animations are those offered for the purchase. See the Animation License Agreement for file-use rights, restrictions and the preservation of earlier licenses.
6. AI receptionist, Inbox and bookings
The practice configures one shared receptionist using saved business information, appearance settings, enabled channels and applicable usage allowances. Chat, voice, translations and approved image-generation features may use third-party AI providers. The practice must review generated content, confirm accuracy and obtain legally required notices, consent and permissions.
AI may produce incomplete or incorrect information. It is not a clinician, emergency service or guarantee of an appointment. A booking request is not a confirmed appointment unless the practice or connected booking service confirms it. Do not use the assistant for urgent symptoms, diagnosis, treatment instructions or decisions requiring a qualified professional.
Inbox conversation history and enquiry records are separate from AI configuration. Reviewed/unread status is a shared practice-workspace state, not proof of email delivery or a patient response. A Lead label denotes an enquiry associated with that conversation; it is not evidence that every conversation from the same visitor generated an enquiry.
Use testing tools for simulated messages and fictitious contact details, not real patient information. Test interactions may consume your chat or voice allowance as described in the test interface. A testing interface should not be treated as a clinical communications channel.
7. Your content, consent and authorized use
You retain rights in your uploaded practice information, photos, before-and-after images, testimonials and other content. You grant us the limited permissions needed to store, process, display and deliver that content and operate the features you choose.
You must have the necessary patient/model releases, copyright permissions and lawful basis for uploading, processing and publishing identifiable or sensitive content. Review privacy settings before publishing. Do not upload information you are not authorized to disclose, fabricate patient results or testimonials, or present generated images as evidence of an actual patient outcome. AI-generated drafts require your review before publication.
Practice pages, hosted embeds and TV slides remain your responsibility for medical accuracy, advertising rules, accessibility, translations and lawful disclosures. Optional WhatsApp, social, phone and booking links are not an endorsement of the destination service.
8. Medical and healthcare-privacy disclaimer
Animations and platform content are educational, not individualized medical advice, professional training or a guarantee of clinical outcomes. Any surgeon-review statement describes content review, not endorsement of your practice, regulatory approval or a result guarantee.
The platform is not an electronic medical-record system. We do not represent that your use is HIPAA compliant, provide a business associate agreement by default, or certify compliance with other healthcare or privacy requirements. Do not submit protected health information where the required safeguards and agreements are absent. The practice must assess its obligations and use an appropriate channel for regulated clinical information.
9. Acceptable use and intellectual property
Do not use the Service for unlawful, infringing, deceptive, discriminatory or harmful activity. Do not impersonate another person, send spam, access another practice’s information without permission, scrape or mass-download the catalog, share purchasing credentials, or use assets to train AI models without written permission.
Do not bypass access controls, watermarks, signed playback/download links, domain or usage restrictions, or capture previews to evade licensing. Authorized editing and use of licensed downloaded files under the EULA are not the same as removing a platform-preview watermark.
Our software, brand and library assets remain protected intellectual property. Your upload does not give us ownership of your content; buying a license does not transfer our copyrights or production/source assets. See Copyright and DMCA / Copyright Policy.
10. Availability, suspension and termination
We use reasonable efforts to operate the Service but do not promise uninterrupted availability, search-engine rankings, delivery of every notification or permanent availability of each third-party feature. Maintenance, provider outages, preparation of watermarked media and security restrictions may limit access.
We may restrict affected access for a material breach, non-payment, fraud or security/legal reasons, subject to applicable law. A product restriction does not automatically cancel unrelated purchased rights. You may contact support about account closure or a data request; deleting an account and cancelling recurring billing are distinct actions. Retention and deletion are described in the Privacy Policy.
11. Existing licenses and contracts
These descriptions govern new purchases made under this version. Rights already acquired under an earlier order, accepted license or separately signed agreement are not retroactively reduced by this update, account navigation changes, or acceptance of updated general terms. Existing paid subscriptions are not automatically cancelled, repriced or converted into another product. The new 3D offering does not promise watermark-free online playback; this operational playback rule does not cancel purchased animation download and file-use rights.
12. Liability and indemnification
To the maximum extent permitted by law, the Service and content are provided as available, without a guarantee of uninterrupted operation or suitability for a particular clinical outcome. We are not liable for indirect, incidental, special, consequential or punitive damages. Our total liability for claims relating to the Service shall not exceed the fees you paid to us in the 12 months preceding the claim; for a claim relating solely to an animation license, the limit is the amount paid for that license. These limits do not exclude liability that cannot lawfully be excluded or limit mandatory remedies.
To the extent permitted by law, you will defend and indemnify TouchApp Inc. against third-party claims arising from your unlawful or infringing content, unauthorized use of licensed assets, or material breach of these Terms. This does not remove protections or remedies that applicable law makes non-waivable.
13. Governing law, venue and changes
These terms are governed by the laws of Delaware, United States, without regard to conflict-of-law principles. Subject to mandatory applicable law, disputes shall be brought in the state or federal courts located in Delaware. Nothing in these documents excludes mandatory consumer, privacy, withdrawal or other rights, or mandatory jurisdiction rules, that cannot lawfully be waived.
The displayed document version identifies the current text. Acceptance may be recorded with the version, time, IP address and user agent. Material updates are notified as described above; previously purchased license scope remains protected. Product-specific agreed orders control their stated scope and price, subject to mandatory law.
